LEN TALIF SAYS PROCLAMATION OF PENAN PEACE PARK
HAS NO LEGAL BEARINGS

Hj. Len Talif Salleh, Acting Permanent Secretary, Ministry of Planning and
Resource Management also Director of Forests, Sarawak issued a statement
today saying that "the establishment of Penan Peace Park announced by 17
Penan Communities at Long Ajeng recently has no legal basis, not in
consultation with the relevant authorities thus not recognised by the
State".
He was responding to recent media report "Borneo Natives Proclaim Tropical
Forest Reserve” where Penan communities were said to proclaim a new forest
reserve. It was reported that the Penan "wish to develop tourism in their
region and insist on the protection of their customary rights". This group
represents a small fraction of the Penan communities against the wishes of
the majority of the Penan population. The former being a group of Penan
instigated and manipulated by foreign NGOs to sensationalize the issue to
raise fund in the international communities, to further their ill intended
agenda. This is a reflection of their post-colonial mentality syndrome
Commenting further on Penan Peace Park areas, Len Talif said "the said
Peace Park is located largely within Permanent Forest Estate (PFE)".
He voiced out his disappointment over the lopsided report which tainted
Sarawak's image and its government effort to date in the area mentioned,
not only directed to assist the Penans but also other communities such as
Kenyah, Berawan, Kelabit, Saban and others, who are also using the forests
for their subsistence.
Citing some examples, Len Talif said "much improvement have been achieved
towards living standards of communities in the area including Penan, but
this was downplayed to serve the purpose of some hidden agenda by some
purported human righteous group who claimed to be NGOs. This is severe,
because their actions, hoodwink and instigations may reap the Penans off
their rights, be opposed to the Government and be anti-development".
"Piped water supply and toilets have been supplied to Long Lobang and Long
Sabai, community-based activities are actively conducted by various
agencies, fruits, and vegetables cultivation with training, planting
material as well as supplies are provided to them, assistance rendered to
facilitate birth certificates and MyKad applications for over 230 people
from more than 10 villages, construction of a suspension bridge across the
30m wide Sg. Kubaan so that the communities will do away with the need to
endanger their lives to cross the fast flowing river and schools in Bario
and Ba' Kelalan even have their own village museum and nature study
centre".
Other State Government initiatives said Len Talif include the Flying
Doctor Service, setting up of Penan Service Center in Long Beruang,
southeast of Pulong Tau National Park, which is equipped with facilities
such as clinic, school, helpdesks and others.
Hence, he added that all these examples are proof that Penans are not
neglected and everyone is included in the State development agenda. Adding
on to that Len Talif assured all "more projects are coming to these areas
in 2010".
However, he wished to highlight to the media that "there are many success
stories of Penans overcoming diversity and successful in their own rights.
We have to tell their stories as well".
"We have to see the bigger picture, analyse the story from different
perspectives and assist the Government to put a stop to sensationalized
provocation, which are meant to jeopardize the harmony and bring havoc,
instead of benefits to the communities" Len Talif emphasized.
The State Government has also embarked the ITTO-supported Project
implemented by Forest Department since year 2005. “One of ITTO's
recommendations at the end of Phase I of the Project was to extend the
national park areas to include community-use zones that integrate
conservation and socio-economic development concept for the communities".
This is not far-fetched from the Peace Park and he added that "for all the
planned projects by the Government to benefit the communities, protests
and empty talks should cease". Instead, he insisted on the Penan groups
that fore fronting the Penan Peace Park "to work in consultation with the
Government and enforce actions rather than be involved in empty promises
by certain quarters to secure better future for their people".
The proclaimed area comprises of areas approximately 1630 squared km (163,
000 hectares) around the Gunung Murud Kecil mountain range near the
Indonesian border and is located between the existing Pulong Tau National
Park in Malaysia and the Indonesian Kayan Mentarang National Park.
Implementation of ASEAN-India Free Trade Area (AIFTA)
Scheme & ASEAN Australia New Zealand FTA (AANZFTA)
STA have received a letter from the Ministry of International Trade
and Industry (MITI) Sarawak Regional Office requesting us to inform all
our members that the AIFTA Scheme and AANZFTA will be implemented with
effect from 1 January 2010, subject to the legal enactment passed by the
Customs.
Members who are exporting products to India,
Australia and New Zealand are to submit/forward the Cost Analysis
Application Form to MITI or its branch offices as soon as possible to
enable MITI to issue an approval before its implementation date.

Logs and Pole Plastic Tag Printing Company
STA
have letters from Forest Department Sarawak (FDS) requesting STA to
inform all our members that there are three companies currently registered
with FDS as Logs and Pole Plastic Tag Printing Company for a period of one
year from 23 December 2009 to 22 December 2010.They are:-
(1) Number System Sdn Bhd, Sibu
(2) Symbol Timber Tags Sdn Bhd, Sibu
(3) Yi Ling Enterprises Sdn Bhd, Sibu
The registration of inkjet printers enables the Department to control,
monitor and verify logs produced and LPI numbers allocated with greater
ease and expediency.
The following conditions and restrictions on tag production (may be varied
or amended from time to time at the discretion of FDS) are imposed on all
registered printing companies:-
(a) All plastic tags supplied shall comply with the specifications and
quality standard as stipulated in DF Circular No 6/2008 (Plastic Tags for
Logs & Pole Size Timber) dated 7 November 2008;
(b) The Company is only allowed to print LPI tags within the range of
numbers that has been approved by Sarawak Forestry Corporation (SFC).
Original approval letter should be submitted to the Company for
verification. The approval letter should be kept properly for FDS auditing
purposes;
(c) The Company is not allowed to print and supply duplicated tags;
(d) Replacement tags can only be printed with an approval letter from SFC;
(e) LPI Alpha-numeric Number in the LPI Coupe and Block Tag must be inkjet
printed effective 1 November 2009; and
(f) FDS, may if deemed necessary, check and audit the Company’s documents
such as monthly submission returns, sale invoices and stock balance for
verification.
(g) Additional terms and condition may be imposed
Effective Date for
the purpose of Article 8(e) of the Articles of Association of Sarawak
Timber Association
The Council resolved in its 72nd Meeting held on 24 November 2009 to call
the Annual General Meeting of the Members of the Association for the
incoming year 2010, on Wednesday, 31 March 2010.
The incoming year 2010 is an election year. The Effective Date for the
purpose of Article 8(e) of the Articles of Association of Sarawak Timber
Association has been fixed to fall on 2 March 2010 (at 5.00pm).
Therefore and in accordance with Article 7(f), all members are advised to
pay their outstanding subscription fees and all dues on or before 5:00pm
on 2 March 2010 to avoid being disqualified from being nominated as a
candidate for election as a Council member and to be entitled to vote on
31 March 2010.
STIDC Registration Circular No 1/2009 - Documentation for Importation of Timber from West Kalimantan Indonesia
STA
have received a letter from the General
Manager of Sarawak Timber Industry Development Corporation (STIDC) on 1
December 2009 via Registration Circular No 1/2009 informing us that any
importation of timber from West Kalimantan Indonesia must be supported by
the following documentations issued by relevant authorities in West
Kalimantan:
(i) Pemberitahuan Ekspor Barang (PEB);
(ii) Pengakuan Sebagai Eksportir Terdaftar Produksi Industri Kehutanan (ETPIK)
[issued by "Direktorat Jenderal Department Perindustrian dan Perdagangan"]
(iii) Surat keterangan Sahnya Hasil Hutan (SKSHH) or Nota Perusahaan,
Endorsement [issued by Badan Revitalisasi Industri Kehutan (BRIK)]
(iv) Laporan Surveyor (LS)
Importers are required to adhere to the above requirements stated therein.
A copy of the "Conditions or Restrictions" dated 1 October 2009 issued by
STIDC which supersedes the previous copy dated 1 August 2008 is attached.

ISPM 15 for Imports
into Malaysia
International Standards for Phytosanitary Measures, publication 15, (ISPM
15) is an international standard on regulating wood packaging material
(WPM) in international trade. It was adopted in 2002 by the International
Plant Protection Convention (IPPC) as part of the United Nations Food and
Agriculture Organization. WPM such as pallets, dunnage, crates, wooden
spools, etc are essential for trade and movement and protection of cargo
and containerized goods. Under the ISPM 15, WPM should be treated in
accordance with a specific time-temperature schedule that achieves a
minimum wood core temperature of 56° Celsius for a minimum of 30 minutes.
This regulation eliminates the presence of pests found in wood,
particularly the Pinewood Nematodes and the Asian Long-Horned Beetles and
will further prevent the introduction and spread of forest pests of
quarantine concern associated with WPM.
The Department of Agriculture (DOA) Malaysia will be implementing ISPM 15
for imports starting 1st January 2010. As such, all wood packaging
material (WPM) used in any consignments imported into Malaysia should be
treated and marked accordingly as prescribed in the regulation. A grace
period of six months from the date of implementation will be given to
allow all government agencies, forwarding agents and the importers to
familiarize with the necessary requirements.

Implementation Date for Issuance of Harwood Transportation Passes
STA received a reply from Harwood Timber Sdn
Bhd (Harwood), Ref. No.: HWT/DGM/sh/L032/2009 dated 29 October 2009 from
the General Manager of Harwood with regards to STA's appeal to defer the
implementation date for issuance of Harwood Transportation Passes.
The Executive Chairman of Harwood has agreed and endorsed the actual
implementation date of the Harwood Transportation Passes to be effective 1
January 2010. At the meantime, Harwood would carry out trial
implementation to ensure that the successful implementation of the Harwood
Transportation Passes on 1 January 2010.

Association (STA).

Survey through the enclosed Questionnaire On Forestry and Timber Industry's Dependence on Foreign Workers (URGENT)
Our government has recently announced that
foreign workers in all categories (except for maids) will only be allowed
to work in Malaysia for a maximum period of five (5) years as one of the
measures to minimize our country's dependence on foreign workers. Other
measures to be implemented are to tighten existing procedures in the
intake of foreign workers and to restrict companies supplying foreign
workers to supply workers for the manufacturing, plantation and
agricultural sectors only.
A large number of STA members have recently raised their concerns about
the abovementioned issues this is because forestry and timber industry of
Sarawak depends highly on foreign manual workers to carry out its
operation. The Association has decided to take the initiative to pursue
the matter urgently with the relevant government authorities to emphasize
the importance of foreign workers to our industry due to the unique nature
of forestry and timber industry of Sarawak. To substantiate the
Association's position paper to the relevant government authorities in
pursuit of this matter, the Association has entrusted STA Labour and
Industrial Relations Committee to carry out a fact finding survey through
the enclosed questionnaire to all members to get feedback as to the
magnitude and importance of foreign workers to the forestry and timber
industry of Sarawak.
In view of the urgency of the matter, we hope that all members will give
your support and actively respond to the enclosed questionnaire
on or before 14 August 2009 to our
STA Secretariat as members' sincere and full support will contribute to
the success of the Association's pursuit of this matter, which in turn
will benefit the forestry and timber industry of Sarawak. Please

A valid export permit from the country of origin, and re-export certificate
from any country of re-export, must be obtained prior to importing ramin into
the U.S. Recently, The Department of Justice announced that a manufacturer of
wooden baby furniture located primarily in China has agreed to pay a fine
amounting to U$40,000 and serve three years of probation to settle charges
that it smuggled into the U.S. cribs containing an internationally protected
tropical hardwood known as ramin. In the U.S., shipments of furniture in
February 2009 were down 20 percent from February 2008.
For 2008, US imports of furniture and bedding decreased 6.49% from 2007 values to US$38.30 billion as the housing industry continued to suffer and the economy began to slow. US imports from Malaysia in this category amounted to US$764.42 million, a decrease of 7.86% from US$829.68 million in 2007. Malaysian exporters of wooden furniture need to be aware of the export permit requirement for ramin to the US and possible fine imposed for not abiding with the requirement. Ramin which is found in tropical forests in Southeast Asia, including and
Malaysia and Indonesia, is said to endanger the habitat of orangutan.
According to the Department of Justice (DOJ), Indonesia has one of the highest
rates of deforestation of any county, much of it due to illegal timber
harvest. Ramin is listed in Appendix II of the Convention on
International Trade in Endangered Species of Wild Fauna and Flora since Jan.
12, 2005.

A delegation of 5, led by Dr. Satriyo Utomo the Deputy Director of
Politeknik Negeri Pontianak (Polnep) from Pontianak visited STA to explore the
possibility their graduates working for member Companies of STA. They were
accompanied by the Secretary of the Consul General of the Republic of
Indonesia, Kuching, Mr. Alexandri Legawa.
Polnep, the biggest polytechnic in Kalimantan Borneo, first started to offer
courses in 1994, now offers 12 three-year Diploma study programmes, of which
the graduates of 6 study programmes, may be suitable for employment in our
industry. The 6 study programmes and the expected number of graduates in
August 2009 are:

Circular on Registration of Printer and Inkjet Printed LPI Number

have received a letter ref DF.93.13.2-9 dated 15 June 2009 from the Director
of Forests Forest Department Sarawak (FDS) addressed to Messrs Yi Ling
Enterprises Sdn Bhd, Symbol Timber Tags Sdn Bhd and Number System Sdn Bhd
respectively on the above subject, a copy of which was extended to the
Association.
Following is the content of the letter, for your information:-

"The Forest Department has decided that the LPI Alpha-numeric Number in the LPI Coupe & Block Tag must be inkjet printed effective 1 November 2009.
Improvement and upgrading in the quality of printing, and the registration of inkjet printers will enable the Department to control, monitor and verify logs produced and LPI number allocated, with greater ease and expediency. Duplication in the printing the LPI number can also be minimized or curtailed.
Tag supplier must have a proper account of all printed LPI Coupe & Block Tags. In this connection, timber licensees are only allowed to order and print LPI range number that has been approved by Sarawak Forest Corporation (SFC) and the original approval letter of LPI, must be attached.
To ensure the success in implementing LPI and to enable the Department to trace LPI Tags to source, all the Inkjet printers operated by you have to be registered with the FDS on or before 1 July 2009 using the format prepared by FDS.
Through the
joint effort, commitment and cooperation from timber operators and tag
suppliers, this exercise will enhance our Log Tracking System (LOTS)
application through FORESTNET. It will also ensure that the noble objective
of using Plastic (PVC) Tag to improve log marking is achieved."

Revised 1st Schedule on Rates of Royalty
STA have been informed by the Forest Department and the Sarawak Forestry Corporation that Majlis Mesyuarat Kerajaan Negeri (MMKN) during its Meeting held on 11 December 2008 has approved the adoption of the revised First Schedule of the Forests Ordinance [Section 52(2)] on Rates of Royalty for Produce Taken Under Licence which shall take effect on 1 January 2009.
